CITY OF SEYMOUR CITY COUNCIL

REGULAR MEETING

AUGUST 24, 2017

 

A Regular City Council Meeting was held on Thursday, August, 24, 2017, at 7:00 p.m., at the Portwood Arts and Civic Center, 800 E. Morris, Seymour, Texas, 76380.

 

Mayor Josh Sosolik led the Call to Order, Roll Call and Pledge of Allegiance at 7:00 p.m.

 

Proclamations regarding the Stroll & Roll Event and Law Enforcement Proclamations were read by the Mayor.

 

Announcements from the Mayor: No announcements were made at this meeting.

 

Citizen’s questions/Comments: No one signed up for questions or comments

 

Council present at meeting: Mayor Josh Sosolik, MPT Jon Hrncirik, Les Hons, Paula K. Vaden, Mary K. Fair and Monty Glass.

 

Counsel present at meeting: City Attorney Jonathan Whitsitt

 

City Staff present at meeting: City Administrator Steve Biedermann and City Secretary Conchita Torrez

 

Guest (s): Cody Robinette, Gloria Estraca, John E. Nelson and Gerald Moore

 

CONSENT AGENDA: (Items listed under the Consent Agenda are considered routine and are generally enacted in one motion. The exception to this rule is that a Council Member may request one or more items to be removed from the Consent Agenda for separate discussion and action.)

 

  1. CONSIDER APPROVING THE CONSENT AGENDA AS FOLLOWS:

a.) Approve Regular Meeting Minutes from Thursday, July 20, 2017 and Special Called Meeting/Budget Workshop Meeting Minutes from July 27, 2017, August 8, 2017, and August 14, 2017.

 

b.) Accept REPORTS:

  1. Monthly Investment Report
  2. First Bank & Trust Bank accounts summary report
  3. Employee/Contract List and Golf Course Membership Total Report   4. Administration and Supervisors Written Reports

 

END OF CONSENT AGENDA

 

Council reviewed the consent agenda and Mayor Sosolik entertained a motion.

Motion made by Council member Monty Glass, second by MPT Jon Hrncirik, to accept the consent agenda as presented by city staff. Motion passes unanimously.

 

Regular meeting closes and Public Hearing will begin at 7:04 p.m.

 

  1. A Public Hearing regarding the amendment to the Agricultural use of property inside the

city limits of Seymour to require a Specific Use Permit for Agriculture and Ranch use in R 1 and

R 2.

 

City Administrator Biedermann read the ordinance regarding the agricultural use of property

requiring a Specific Use Permit. He also explained that the current ordinance as it reads,

provides no protection for property owners within a 200 feet radius. If someone bought a piece

of property beside you they could plant anything they wanted to and it could devaluate your

property. This ordinance would prohibit someone from doing that.

 

Mr. John Nelson addressed the Mayor and City Council and asked if this ordinance would affect

his property and land. City Council addressed the question and assured him it would not, as he

doesn’t have any neighbors around his land that would be affected by this ordinance.

 

After reviewing the ordinance the public hearing was closed.

 

Public Hearing closes and Regular meeting resumes at 7:27 p.m.

 

  1. Discuss, consider and approve Ordinance 2017-06, an Ordinance amending the Specific

Use Permit for Agriculture and Ranch use in R1 and R2.

 

Mayor Sosolik entertained a motion to pass Ordinance 2017-06.

 

Motion made by Council member Monty Glass, second by MPT Jon Hrncirik, to approve

Ordinance No. 2017-06. Ordinance died for lack of ayes.  Council members Hons, Vaden and

Fair voted against said ordinance.

 

  1. Discuss, consider and take action regarding request from Bobby Moore, President of

The Top of Texas Seymour Pee Wee Football team by providing electric service during

the home games beginning August 2017 through November 2017.

 

Cody Robinette, Secretary of Board, for the Top of Texas, presented City Secretary Torrez with a

schedule of the home games. City Council explained that each year The City of Seymour

provides the football team with electricity. Home games are scheduled for September 2nd,

September 16th, September 30th and October 7th.

 

A motion was entertained by Mayor Sosolik.

 

Motion made by MPT Jon Hrncirik, second by Council member Monty Glass, to approve electric

service during the home games for the Top of Texas Seymour Pee Wee Football. Motion passed

unanimously.

 

  1. Discuss, consider and take action to approve City of Seymour bills paid for the

month of July, 2017.

 

City Council reviewed the bills paid for the month of July, 2017. Mayor Sosolik entertained a

motion.   Motion made by MPT Jon Hrncirik, second by Council member Monty Glass to approve

bills for the month of July, 2017. Motion passed unanimously.

  1. Discuss, consider and review the City of Seymour Water Well Report.

 

The water well report was reviewed by City Council and City Administrator Biedermann.

 

At this time Council does not feel the need to change the current status on our water situation.

No action is taken on this agenda item.

 

At this time, Mayor Sosolik called for a 5 minute recess.

 

Recess (Regular meeting) closes at 7:40 p.m. and Executive Session begins

 

  1. An Executive Session (closed to the public) and pursuant to Chapter 551 of the Texas Local

Government Code under § 551.072;   Real Property; Discussion regarding described property

of the City of Seymour, located on the north and west side of tennis courts.

 

Executive Session closes and Regular meeting resumes at 7:50 p.m.

 

  1. Discuss and take action regarding deliberations from Executive Session.

Motion made by Council member Les Hons, second by Council member Monty Glass, to proceed

with conveyance of subject property to SISD, pending review of the City’s attorney.

Motion passes unanimously.

 

  1. Adjournment by MPT Jon Hrncirik, second by Council member Monty Glass to adjourn at

7:51 p.m. Motion passes unanimously.
