MEETING MINUTES

A Regular City Council Meeting, was held on Thursday, February 15, 2024, at 7:00 p.m., at the Portwood Art & Civic Center, 800 E. Morris Street, Seymour, Texas 76380. All notices were duly posted in accordance and conformance with the Government Code of the State of Texas, Section 551.072 (c.) The City of Seymour attempted to make its meetings accessible to all its citizens. If need of auxiliary aids, the City Secretary was notified at (940) 889-3148, at least 48 hours in advance.  The agenda was also posted on the city’s website at www.cityofseymour.org, with the following agenda considered:

CITIZEN COMMENTS

  1.  Rebecca Golding – 2 comments were read aloud concerning Card Board Recycling & a request for additional Hospital directional signage
  2. Robert Golding – Comment was made concerning speeding on West Ingram Street
  3. Oscar Valdez – Expressed his support for keeping the gun range open
  4. Briley Hostas – Expressed her support to close the gun range due to safety issues

PUBLIC HEARINGS

  1. This public hearing is in regard to a SPECIFIC USE PERMIT, ZONING change of 908 ½ N Browning, also known as Lot 8, Blk 2, Subd Bennett, in Seymour Texas.  Specific Use Permit would allow for the use of a recreational vehicle as a residence.
  2. This public hearing is in regard to a SPECIFIC USE PERMIT, ZONING change of508 W Ingram, also known as Lot 4, Blk 11, Subd Miller 1st in Seymour Texas.  Specific Use Permit would allow for the use of a recreational vehicle as a residence.

CONSENT AGENDA

  1. Approval of the January 18, 2024 Regular City Council Meeting Minutes
  2. Approval of the City of Seymour Accounts Payable Bills for the month of January 2024.
  3. Approval of Clean Up Week to be held April 6th through April 14th, allowing the Seymour Transfer Station to be open Monday – Saturday, regular business hours from 10am to 5pm & and closed for lunch from 12pm to 1pm at no cost to City of Seymour residents.
  4. Approval of RESOLUTION  NO. 1564, authorizing the EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT PROGRAM (JAG), CRIMINAL JUSTICE DIVISION Grant to be operated for the 2024 Fiscal Year
  5. Approval of RESOLUTION  NO. 1565, authorizing the Rifle-Resistant Body Armor under the Texas General Appropriations Act, Article I, Rider 26 for Trusteed Programs within the Office of the Governor to be operated for the 2024 fiscal year
  1. Amend Ordinance 2023-08 to read “Regular Membership fees and Elite Membership fees to be effective JULY 1, 2024” instead of the original date of May 1, 2024 to maintain congruency with previous policy

Motion was made by Councilman Skyler Henricks to approve the consent agenda, 2nd by Monty Glass.  Motion passes 5-0

ACTION ITEMS

  1. Discuss, Consider, and take action on the Racial Profiling Report provided by Seymour Police Department

Motion was made by Lan Winn to accept the Racial Profiling Report as presented by Bryce Sawyer, 2nd by Debbie Gillispie.  Motion passes 5-0

  1. Discuss, Consider, and give direction on pursuing a loan through the Texas Water Development Board

Discussion was had.  Motion to table the item was made by Billy Henricks, 2nd by Monty Glass.  Motion passes 5-0.

  1. Discuss, Consider, and take action on RESOLUTION NO. 1563, A RESOLUTION ESTABLISHING PROCEDURES TO CALL A GENERAL ELECTION TO BE HELD SATURDAY, MAY 4, 2024, IN SEYMOUR, TEXAS AND APPOINTING ELECTION OFFICIALS.  A GENERAL ELECTION TO ELECT THE FOLLOWING CANDIDATES:

Council Member – Place 1                           2 Year Term

Council Member – Place 3                           2 Year Term

Council Member – Place 5                            2 Year Term

Appointing judges for said election: (A) Presiding Election Judge, (B) Alternate Election Judge, and
(C) Early Voting Deputy Clerk

The clerks for the election will be appointed by the Presiding Judge in number not less than two (2).

Motion was made by Skyler Henricks to approve Resolution 1563, 2nd by Lan Winn.  Motion passes 5-0.

  1. Approve 2024 City of Seymour Pool Schedule and prices.  Hours, admission, parties, etc are proposed to remain the same as last year’s 2023 season.

Motion was made by Debbie Gillispie to approve the 2024 City of Seymour Pool schedule and prices, hours, admission prices, and party fees to remain as 2023 fee and hour schedule, 2nd by Monty Glass.  Motion passes 5-0

  1. Discuss, consider, and take action on the Seymour Gun Range

Council chose to enter into executive session to consult with Attorney at 8:40pm

Resumed item #13 at 9:20pm after closing executive session.

  • Missy Gray spoke against keeping the gun range open.
  • Corley Latham spoke against keeping the gun range open.
  • John Hostas spoke against keeping the gun range open.  Spoke candidly about an incident involving a bullet that he believes originated from the gun range.
  • Leonard Estraca spoke against keeping the gun range open
  • Jenny Moline spoke against keeping the gun range open.
  • Lynn Smith spoke about his experience of owning a gun range and gun shop in Jacksboro and some the safety precautions they take into consideration.  Mainly the importance of not shooting alone.
  • Oscar Valdez spoke against keeping the gun range open after hearing testimony from others.
  • Eric Hostas spoke against keeping the gun range open
  • Jesse Hernandez spoke against keeping the gun range open after hearing the testimony of others.
  • Todd Hrncirik spoke about the timelines, operational procedures, and history of the gun range.
  • Alecia Hostas spoke against keeping the gun range open.
  • Briley Hostas spoke against keeping the gun range open.

Motion was made by Skyler Henricks to close the Gun Range until further notice, 2nd by Debbie Gillispie.  Motion passes 4-1 with a Nay vote from Monty Glass.

  1. An Executive Session pursuant to Section 551.074, Texas Government Code, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee – Chief of Police
  2. An Executive Session, closed to the public and pursuant to Chapter 551 of the Texas Local Government Code under § 551.071: Consultation with attorneys regarding Special Utility District Baylor Water.
  3. An Executive Session, closed to the public and pursuant to Chapter 551 of the Texas Local Government Code, under §551. 071: An agenda item that requires consultation with City Attorney.

ADJOURN – Motion was made by Monty Glass, 2nd by Billy Henricks. Motion passes 5-0.  Adjourned at 10:21pm
