CITY OF SEYMOUR

REGULAR COUNCIL MEETING

JULY 20, 2017

 

A Regular City Council Meeting was held on Thursday, July 20, 2017 at 7:00 P.M. at the Portwood Arts and Civic Center, 800 E. Morris, Seymour, TX  76380.

 

Mayor Josh Sosolik called the meeting to order, roll call and Pledge of Allegiance at 7:00 p.m.

 

Council present: Mayor Josh Sosolik, Council members Les Hons, Paula K. Vaden, MPT Jon Hrncirik, Mary K. Fair and Monty Glass.

 

Counsel present: City Attorney Jonathan Whitsitt

 

City Staff: City Administrator Steve Biedermann, City Secretary Conchita Torrez and Judge Jim Castagna.

 

Guests: Allen Phillips , Jacob and Martin representative,  Jared Bodkin and Gerald Moore.

 

Announcements from the Mayor: No announcements at this time.

 

Citizen’s questions and/ or comments: No one signed up at this meeting for questions or comments.

 

CONSENT AGENDA: (Items listed under the Consent Agenda are considered routine and are generally enacted in one motion. The exception to this rule is that a Council Member may request one or more items to be removed from the Consent Agenda for separate discussion and action.)

 

  1. CONSIDER APPROVING THE CONSENT AGENDA AS FOLLOWS:

 

  1. A) Approve Thursday, June 15, 2017, Regular Meeting Minutes and Thursday, June 22, 2017, Special Called Meeting Minutes.

 

  1. B) Accept Reports:
  2. Monthly Investment Report
  3. First National Bank Account Summary Report
  4. Employee & Contract List /Salt Fork Membership Report
  5. Written reports from City Administrator and Supervisors

 

  1. C) Accept and approve the City of Seymour Quarter 3 Investment Report, as presented by Investment Officers.

Motion made by Council member Monty Glass, second by Council member Les Hons to accept the consent agenda as presented. Motion passed unanimously.

 

 

  1. Discuss, consider and take action regarding Installation Bids received for the City of Seymour Sewer System Improvement Project #7216411, on July 14, 2017.

 

Allen Phillips with Jacob & Martin, informed the Mayor and City Council that three bids had been received and opened on July 14, 2017, regarding the Sewer System Improvement project from the following:

 

(1) J & J Farms – $155,260.00

 

(2) WhiteWater Construction – $249,095.00

 

 

(3) MH Civil – $314,000.00 .

 

Motion made by MPT Jon Hrncirik, second by Council member Les Hons to approve and accept bid received from J & J Farms, with option #2 and allow a $2,500 deduct by allowing the City of Seymour to do the fence repair. Motion passed unanimously.

 

  1. Discuss, consider and take action regarding Material Bids received for the City of Seymour Sewer System Improvement Project #7216411, on July 14, 2017.

 

Allen Phillips with Jacob & Martin, informed the Mayor and City Council that three bids had been received and opened on July 14, 2017, regarding the Sewer System Improvement project from the following:

 

(1) Morrison Supply Co. – $ 52,196.80

 

(2) J & J Farms – $57,439.00

 

(3) BenMark Supply Co. – $61,972.06

 

Motion made by Council member Monty Glass, second by MPT Jon Hrncirik, to approve and accept bid received from Morrison Supply Co. Motion passed unanimously.

 

  1. Discuss, consider and take action regarding presentation from Gerald Moore in relation to Golf Cart Ordinance No. 2016-05.

 

Mr. Gerald Moore had asked to address the Mayor and City Council regarding the current Golf Cart Ordinance.   Mr. Moore expressed his concerns due to this ordinance affecting his way of getting around in town as this is his form of transportation. He feels that this ordinance is not necessary and we should do away with it.  He contacted the Department of Justice and would like for us to do the same.  Jonathan Whitsitt will contact the ADA and Department of Justice to find all the rules, policies and guidelines regarding Golf Carts.  It was agreed upon to allow Mr. Whitsitt to investigate this and get back with City Administrator Steve Biedermann.

 

  1. City Administrator Steve Biedermann will discuss and review the permitted use of Agriculture/Ranch Use in Residential Zoned Areas. (No action will be taken on this agenda item)

 

Information was presented to the City Council by City Administrator Steve Biedermann regarding a proposed change to Agricultural/Ranch Use in Single Family (R1) and Two Family (R2) Residential zoned districts. The current zoning ordinance allows unrestricted Agricultural/Farm Use in R1 and R2 zoned areas without due consideration of the Council or surrounding property owners.  This can result in decreased property values of the immediate area and the increased presence of unwanted vermin including hazardous snakes and insects.  This proposed change to the current ordinance would require the notification and input of residents in the immediate area and the approval of the City Council before an Agricultural/Farm Use can be placed in R1 and R2 zoned areas.

 

No action was taken as this will be placed on the August agenda for further discussion and possible action.

 

  1. Discuss, consider and take action to change the August 17, 2017, Regular Council Meeting, to August 24, 2017.

 

Motion made by Council member Monty Glass, second by Council member Les Hons, to allow City Staff to change the Regular City Council Meeting to August 24, 2017.

Motion passed unanimously.

 

  1. Discuss, consider and take action to approve City of Seymour bills paid the month of June, 2017.

 

Council reviewed the City of Seymour bills paid in the month of June, 2017.

 

Motion made by Council member Les Hons, second by Council member Monty Glass to approve city bills. Motion passed unanimously.

 

 

 

 

 

 

 

 

  1. Discuss and review the City of Seymour Water Well Level Report as presented in graph form by Water Production Supervisor Jason Bench.

 

City Administrator Steve Biedermann discussed the water graph with the Mayor and City Council. All the wells right now look good and are holding their own.  No action was taken on this agenda item.

 

  1. Adjournment by MPT Hrncirik , second by Council member Glass to adjourn at 7:49 p.m. Motion passed unanimously.
