Executive Session (closed to the public) and pursuant to Chapter 551 of

 the Texas Local Government Code§551.071 Consultation, with City Attorney/City Council Workshop. This workshop will be held on Thursday, June 17, 2021, at 5:00 p.m. at the Portwood Art & Civic Center, 800 E. Morris Street, Seymour, Texas. All notices have been duly posted in accordance and conformance with the Government Code of the State of Texas, Section 551.002 (c ). REGULAR MEETING MINUTES

JUNE 17, 2021

A Regular City Council Meeting was held on Thursday, June 17, 2021, at 7:00 P.M. at  Portwood Art & Civic Center, 800 E. Morris Street, Portwood Art & Civic Center, Seymour, Texas.

Call to Order, Roll Call and Pledge of Allegiance by Mayor Jon Hrncirik  

Council present: Mayor Jon Hrncirik, Council Member Lan Winn, Council Member Brian Broome, Council Member Jay Hudson, MPT Monty Glass, Council Member Les Hons

City Counsel: City Attorney was not present at this meeting

Consent Agenda:

1. Consider Approving the Consent Agenda as follows:

a)  Approve ratified and corrected meeting minutes from April 15, 2021, May 4, 2021, May 6, 2021, May 20, 2021, May 27, 2021, for all council action in one vote as per City Attorney.

b.) Employee & Contract List/ SFRC Membership Total (104)

c.)  Written reports by City Administrator and Supervisors

d.) Approve Resolution No. 1506- Personnel Policy Manual by adding language to Section: Volunteer Vacation hours

e.) Approve and change Regular City Council meetings in July 2021 and August 2021 to Tuesday, July 20, 2021, and Thursday, August 26, 2021, due to conflicting schedules

f.) Approve accounts payable bills in the month of May 2021, in the amount of $489,049.65.

g.) Chip Quote from Austin Wood Recycling to complete job for the Street Department in the amount of $28,500.00 for the Radio Tower Brush Site and $5,000.00 for Mobilization fee.

h.) Approve the Entity Signature Authorization Form between City of Seymour and Peoples Bank, in Seymour Texas.

i.) Accept and approve letter of Resignation from Judge Rusty Stafford, from the Seymour Airport Board, effective immediately.

j.) Accept and approve agreement between City of Seymour Electric Department and Texas Electric Cooperatives.

Council Member Les Hons stated he would like to know about the purchasing policy and going out for bids.

City Administrator Brasher explained consent agenda item (g) to his attention for several reasons. One, was that TCEQ had seen the pile and asked the city to take care of it or we would get a write up, warning or fine. Seymour has used this company for the past decade, and I was also informed that this is the only company in the State of Texas that does this line of work. Now, our policy does state that the limit is 25K, but it is the council’s prerogative to pass if they choose to do so.

Council Member Brian asked if the State Law was 50K.  Mr. Brasher answered yes, that was his understanding.  Our policy states 25K, but city council may override their own policy.

Motion made by MPT Glass to approve consent agenda as read, seconded by Council Member Lan Winn.  Motion carried 5/0

2. Public Hearings

(a.)  The City of Seymour to hold a Final Public Hearing regarding Byron Latham requesting a Specific Use Permit, concerning Lot 4, Block 4, of the SD Addition comprised of .09 acres, located at 1003 N. Cedar Street, in Seymour, Texas.

Lauren Bush stated this was the second public hearing as required by law and for the community to speak on it and council to make a decision on this Specific Use permit.  This is to allow a recreational vehicle at the residence.  

Council Member Broome asked regarding the note that stated 6 months to a year.  Lauren stated no, that was something she wrote on accident it was not for this application.  

(b.) The City of Seymour to hold a Public Hearing regarding PINNACLE requesting a Specific Use Permit, concerning Parcel 38329, Lots 3-7, Block 1, of the McCord Addition in Seymour, Texas.

This is the first required public hearing on this agenda item as requested from Mr. Lemons who is not the owner of the property.  The property belongs and is owned by Carl Lohman. There is a map enclosed in your packet, for the proposed tower. Tower would be 190 feet tall, set on a 25 foot base with a fence surrounding it. Matt Gwinn requested that if a light is on it that it be a red light instead of white.

(c.) The City of Seymour to hold a Public Hearing regarding Loy Studer requesting a Specific Use Permit, concerning Lot 13, Block 18 of the Original Seymour Addition, comprised of .1 acres in Seymour, Texas. Also known as 201 N. East Street.

ED Director Lauren Bush explained that this is the first public hearing of two as required by law.  Mr. Studer purchased back this piece of property and his intentions are to make it a mini 3-4 RV spaces.

No action taken as this is the first of two Public hearings.

d. The City of Seymour to hold a Public Hearing regarding Danny Hrncirik requesting a Re-Zone Request, concerning Lots 7-10, Block 30 of the Original Seymour Addition, comprised of .643 acres in Seymour, Texas. Also known as 406 S. Tackitt Street.

ED Director Lauren Bush explained that this was the first of two public hearings and Mr. Danny Hrncirik was requesting a re-zone, concerning lots 7-10, Block 30 of the Original Seymour Addition, comprised of 0643 acres in Seymour, Texas.  Property also known as 406 S. Tackitt Street.

She went on to explain that there were two lots, the larger lot was a B-1, while the smaller lot was a R-1. His whole area was not zoned properly, and this needed to be addressed. This property will be re-zoned as a B-2 if approved by City Council.

No action taken as this is the first of two Public hearings.

3.  Discuss, consider, and take action regarding request from Byron Latham for a Specific Use Permit, regarding property located at 1003 N. Cedar Street, described as Lot 4, Block 4, of the SD Addition comprised of .09 acres.  

ED Director Lauren Bush explained that this was the final Public Hearing regarding Byron Latham’s request for a Specific Use Permit.  His property is located at 1003 N. Cedar Street, also described as Lot 4, Block 4, of the SD Addition, comprised of .09 acres. 

Motion made by Council Member Les Hons, seconded by MPT Monty Glass, to approve Specific Use Permit for 1003 N. Cedar Street.  Motion carries 5/0

4. Discuss, consider, and take action to review and accept a mowing bid

Exhibit B- Sound Garden   100.00          

Exhibit C- Seymour Park, City Pool/Splash Pad, Portwood Pavilion, Chamber of Commerce Bldg. $1,600.00

Exhibit D- Hospital Hill – $1,000.00   

Exhibit E- Downtown Media $200.00

Exhibit F- Seymour Speedway (Go Cart Track) $300.00

Bid from JTE Lawn Care

JTE Lawn Care bid $11, 308.00 for 14 weeks &   $42,000.00 for 52 weeks

Other exhibits that were included in the contract for JTE Lawn Care are as follows:

After reviewing both bids, Mayor Hrncirik entertained a motion.

Motion made by Council Member Les Hons, second by Council Member Jay Hudson, to hire JTE Lawn Care to provide mowing services for the next 14 weeks and continue to look for someone who is willing to work full time for the City of Seymour. Motion passed with 3 Yeas  2 Nays (Glass and  Winn)

5. Discuss, consider, and take action to appoint someone to the Rolling Plains Board.  

Mayor Hrncirik explained to City Council that there is a need for a board member to be appointed. Mayor Hrncirik feels that there should be two people citizens in the event one cannot make it, the other one would feel in.  Lauren Bush stated she would be glad to serve, but would ask that she either be reimbursed by being able to take off and flex her time off, or clock in and out

when a meeting is involved.

Council agreed to allow Lauren to flex off time or clock in and out and get compensated. A motion was entertained by Mayor Hrncirik.

Motion made by MPT Glass, second by Council Member Lan Winn, to approve the appointment of Lauren Bush to the Rolling Plains Board.  Motion carried 5/0

6.  Adjournment of meeting

Motion made by Council Member Lan Winn, seconded by MPT Monty Glass, to close meeting at 9:37 p.m.  Motion carried 5/0
