REGULAR CITY COUNCIL MEETING
MAY 15, 2014
A Regular City Council Meeting was held on Thursday, May 15, 2014 at 7:00 P.M. at the Portwood Arts and Civic Center, 800 E. Morris, Seymour, TX 76380.
CALL TO ORDER / ROLL CALL / PLEDGE OF ALLEGIANCE BY MAYOR TOBY HINES AT 7:02 P.M.
A Proclamation regarding Tourism week was read by Mayor Hines.
Council Members Present: Mayor Toby Hines, Council members Donald Coltharp, David Horton, MPT Nan Gilbert-Mathis, Billy Henricks and Monty Glass.
Counsel Present: No counsel was present at this meeting.
City Staff Present: City Administrator John Studer and City Secretary Conchita Torrez.
Guests: Patty Hines, Jon Hrncirik and Election Judge Kathy Harper.
ANNOUNCEMENTS FROM THE MAYOR:
Mayor Toby Hines congratulated Council Member Coltharp for his 16 years of service to City Council and this community. He also wished well Nan Gilbert-Mathis for her 6 years of service to this community and city council.
CITIZENS QUESTIONS AND / OR COMMENTS: CONSENT AGENDA:
No one had any comments or questions at this time.
- CONSIDER APPROVING THE CONSENT AGENDA AS FOLLOWS:
a) Approve Thursday, April 17, 2014, Regular Meeting Minutes.
b) Approve the City Council Report for City Bills paid in April 2014.
c) Accept Reports
1. Monthly Investment Report
2. First National Bank accounts report summary
3. Employee List /Golf Course Membership Report
- Seymour Police Department Report
END OF CONSENT AGENDA
Motion made by Council member Monty Glass, seconded by Council
Member David Horton, to approve consent agenda as presented.
Motion passed unanimously.
2. Canvass of Election Returns regarding May 10, 2014, General Election for
two-year terms for City Council Position #1, Councilmember Place #3 and
Councilmember Place #5, as reviewed by Council Canvass Subcommittee:
Councilman David Horton and Billy Henricks. Election Judge Kathy Harper,
will present Canvass of Election.
2014 Election Judge Kathy Harper presented the canvass of election to the
Mayor and City Council . Canvass recorded in the minutes as follows:
Donald Coltharp received a total of 113 votes, Les Hons received a total of
151 votes, declaring Les Hons as the winner for Council Place One.
Nan Gilbert-Mathis received a total of 104 votes, Jon Hrncirik received a total
of 159 votes, declaring Jon Hrncirik as the winner for Council Place Three.
David Frey received a total of 130 votes, Monty Glass received a total of 132
votes, declaring re-elect Monty Glass as the winner for Council Place Five.
No action was required on the canvass as this is passed in a form of a
resolution.
3. Consider Approving Resolution No. 1383, declaring the Results of 2014 City
Officer (s) Election.
RESOLUTION NO. 1383
A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF THE MAY 10, 2014, ELECTIONS FOR CITY COUNCIL OFFICERS.
PLACE 1, 3 AND 5
On this the 15th day of May , 2014, the City Council of the City of
Seymour, Texas, convened in a Regular Called Meeting, open to the public at 800 E. Morris Street, Portwood Art & Civic Center, Seymour, Texas 76380.
Council Member David Horton, introduced a resolution and order and moved its adoption. The motion was seconded by Council Member Billy Henricks, and the motion carried with it the adoption of the resolution and order prevailed by the following vote:
AYES: 5 NOES: 0
There came to be considered the returns of a General Election held on the 10th day of May, 2014, for the purpose of electing the hereinafter named officials, and that each of the candidates in said election received the following votes:

Councilmember Place #3 Votes Cast
Nan Gilbert-Mathis 104

THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE
CITY OF SEYMOUR, TEXAS:
That said election was duly called; that the notice of said election was given in accordance with law, and that said election was held in accordance with law, and that LES HONS, was duly elected to Council Member Place #1, JON HRNCIRIK, was duly elected to Council Member Place 3, and MONTY GLASS, was duly re-elected to Council Member Place 5, each in the General Election for a two-year term. Said above named parties are hereby declared duly elected to said respective offices, subject to the taking of their oath of office as provided by the laws of the State of Texas.
It is further found and determined that in accordance with the order of this governing body the Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located in the City Hall, a place convenient and readily accessible to the general public, and said notice having been posted and remaining posted continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return of said posting shall be attached to the minutes of this meeting shall be made a part thereof for all intents and purposes.

Motion made by Council member David Horton, seconded by Council member Billy Henricks, to accept the canvass of election as presented. Motion passed unanimously.
4. Statement of Elected Officer signed and filed with the City Secretary from
City Council for Councilmember Place #5.
The Statement of Elected Officer was read, signed and filed in the City Secretary office by re-elected Council Member Monty Glass.
- Oath of Office Administered to City Council Member Place #5.
Mayor Toby Hines administered the Oath of Office to Monty Glass for Council Place five.
- Certificates of Election issued to City Councilmember Place # 5.
Mayor Toby Hines presented Council Member Monty Glass with a Certificate of Election.
Mayor Toby Hines announced that there would not be an executive session held at this time.
Regular Meeting Ends and Executive Session begins: CANCELLED
- The Seymour City Council will convene in closed session as authorized by Texas Government Code, Chapter 551, Section 551.074: Information to discuss or deliberate issues regarding water department.
Executive ends and Regular Meeting begins: No executive session took place.
- Take action if any, resulting from deliberations during Executive Session.
No action taken as executive session was cancelled.
- Adjournment by MPT Nan Gilbert-Mathis, seconded by Council member Monty Glass at 7:20 p.m. Motion passed unanimously.
