RESOLUTION NO. 1494

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEYMOUR, TEXAS, DECLARING A LOCAL DISASTER; PROVIDING FOR IMPLEMENTATION OF THE CITY’S EMERGENCY MANAGEMENT PLAN; PROVIDING PROMPT AND GENERAL PUBLICITY; GRANTING THE MAYOR THE POWER AND AUTHORITY TO REVIEW, ADOPT, RATIFY, AND EXECUTE ANY SUBSEQUENT BAYLOR COUNTY EMERGENCY ORDERS ON BEHALF OF THE CITY COUNCIL; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, beginning in December 2019, a novel corona virus, now designated SARS-Cov2, which causes the disease COVID-19, has spread through the world and has now been declared a global pandemic by the World Health Organization; and

WHEREAS, symptoms of COVID-19 include fever, coughing, and shortness of breath, in some cases, the virus has caused death; and

WHEREAS, extraordinary measures must be taken to contain COVID-19 and prevent its spread throughout Baylor County, including the quarantine of individuals, groups of individuals, as, and property and, additionally, including compelling individuals, groups of individuals, or property to undergo additional health measures that prevent or control the spread of disease; and

WHEREAS, the Mayor of the City of Seymour, Texas has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect the health, safety and welfare of its citizens; and

WHEREAS, the City of Seymour is a Type A General Law municipal corporation, grants the Mayor of the City of Seymour, Texas the authority to declare a local state of disaster; and

WHEREAS, on April 2, 2020, the Mayor of the City of Seymour, Texas updated, issued and duly filed with the City Secretary’s Office, a declaration of local disaster for public health emergency; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEYMOUR, TEXAS:

SECTION 1. That at a local state of disaster for public health emergency is hereby declared for Seymour, Texas, pursuant to section 418.108 (a) of the Texas Local Government Code.

SECTION 2. That pursuant to section 418.108 (b) of the Government Code, the state of disaster for public health emergency shall continue until further notice from Governor Abbott.

SECTION 3. That the City’s Emergency Management Plan has been implemented in accordance with the Code of Ordinances.

SECTION 4. That the Mayor be delegated and given the full power and authority of the City Council to review, ratify, and adopt any subsequent Baylor County emergency orders relating to the COVID-19 pandemic, and that the Mayor execute any resolution or other document to ratify and adopt any such order.

SECTION 6. That the City Secretary shall give prompt and general publicity to this order declaring a local state of disaster.

SECTION 7. That this resolution shall take effect immediately from and after its issuance.
