SPECIAL CALLED CITY COUNCIL MEETING
NOVEMBER 6, 2014
A Special Called City Council Meeting was held on, Thursday, November 6, 2014 at 6:00 P.M. at the Portwood Arts and Civic Center, 800 E. Morris, Seymour, TX 76380.
Call to order, roll call and Pledge of Allegiance was led by Mayor Nan Gilbert-Mathis at 6:00 p.m.
Council present: Mayor Nan Gilbert-Mathis, Council members Les Hons, David Horton, Jon Hrncirik, MPT Billy Henricks and Monty Glass.
Counsel present: Cindy Ayres, City Attorney
City Staff Present: City Secretary Conchita Torrez
Regular Meeting Closes and Executive Session(s) begin at 6:01 p.m.
1.) An Executive Session (closed to the public) pursuant to Chapter 551 of the Texas Local Government Code under §551.074: Deliberation regarding personnel matters; to conduct an interview with City Administrator applicant
Executive Session one ends at 7:28 p.m., and Executive Session two starts at 7:35 p.m.
2.) An Executive Session (closed to the public) pursuant to Chapter 551 of the Texas Local Government Code under §551.074: Deliberation regarding personnel matters; to conduct an interview with City Administrator applicant
Executive Session closes and Regular Meeting resumes at 8:45 p.m.
3.) Take action regarding deliberation from Executive Session one.
Motion made by Council member Jon Hrncirik, second by Council member Les Hons to take no action from deliberations regarding executive session one.
Motion passed unanimously.
4.) Take action regarding deliberation from Executive Session two.
Motion made by Council member Les Hons, second by Council member David Horton, to take no action regarding deliberations regarding the second executive session .
5.) Discuss and give Economic Development Director Lauren Bush, direction regarding the Communities of Distinction project.
Economic Dev. Direction presented to Mayor and City Council, that after receiving further information regarding the Communities of Distinction, the amount of money that it would cost to further this project, could be spent on something else. Therefore, she asked that Council not participate in this project.
Motion made by MPT Billy Henricks, second by Council member Monty Glass to reject the Communities of Distinction project at this time and not participate.
Motion passed unanimously.
6.) Discuss and allow City Secretary to make an addendum to the May 19, 2014, Special Called Meeting Minutes and reflecting clarification regarding action taken on Water/Sewer Supervisor Position.
Mayor Nan Gilbert-Mathis asked that the meeting minutes for May 19, 2014, be clarified regarding action taken.
Motion made by Council Les Hons, second by MPT Billy Henricks for meeting minutes to read as follows with changes added to previous meeting minutes:
To reflect that on May 19, 2014, Greg Shumate, Water/Sewer Supervisor was demoted to a non supervisor position with a decrease in pay and Monty Young was promoted as Interim Water/Sewer Supervisor immediately.
Mr. Young was placed on a 90 day probation period and would be re-evaluated after 90 days. These corrections were added to the May 19, 2014 meeting minutes. Motion passed unanimously to accept the changes.
7.) Discuss and allow City Secretary to make an addendum to the September 4, 2014, Special Called /Budget Workshop Meeting Minutes and reflecting clarification on raises, by Performance Evaluation.
Mayor Nan Gilbert-Mathis asked that the meeting minutes for September 4, 2014, Special Called/Budget Workshop Meeting reflect clarification regarding raises, as this was a change that had been made during the budget workshop.
Motion made by Council member Les Hons, second by Council member Monty Glass, to allow the City Secretary to add to the previous meeting minutes on September 4, 2014, the clarification regarding employee raises to be given by performance evaluation rather than clear across the board. Motion passed unanimously.
8.) Discuss and give direction to City Secretary regarding janitorial services for the Portwood Art & Civic Center.
Discussion regarding the janitorial services for the Portwood Art & Civic Center was discussed by Mayor and City Council. Currently no one holds this position.
Motion made by Council member David Horton, second by Council member Monty Glass, to allow City Secretary to place a bid notice in the BANNER for three weeks and present bids at the Regular City Council Meeting in December, 2014. Also, to have Parks and Recreation supervisor Todd Hrncirik, open and close facility as needed. Council also asked that City Secretary contact the current contract person at City Hall and see if she would be interested in maintaining the facility until such position is filled. Motion passed unanimously.
9.) Discuss, consider and take action authorizing Mayor Nan Gilbert-Mathis and City Secretary Conchita Torrez the authority to perform duties of City Administrator until such position is filled. In the absence of Mayor Gilbert-Mathis, MPT Billy Henricks will be authorized to perform such duties.
City Attorney recommended that the City of Seymour ratify the past actions taken by MPT Billy Henricks, City Secretary Conchita Torrez and actions currently taken from Mayor Nan Gilbert-Mathis, in their performance of duties of City Administrator, until such position is filled.
Motion made by Council member Jon Hrncirik, second by Council member David Horton, to ratify the past and future actions of Mayor Nan Gilbert-Mathis, MPT Billy Henricks and City Secretary Conchita Torrez, in their performance of duties of City Administrator, until such position is filled. Motion passed unanimously.
10.) Discuss, consider and take action regarding request from Milton Wilkerson, residing at 510 N. Cedar Street, granting a perpetual easement from the City of Seymour, by allowing the encroachment to remain on his property.
Mr. Wilkerson requested from City Council the encroachment to remain on the property described as 510 N. Cedar Street. At this time City Attorney asked that the wording read City property instead of his property.
Motion made by MPT Billy Henricks, second by Council member Monty Glass, to accept Mr. Wilkerson’s request and allow a perpetual easement to be drawn up for the encroachment of property. City Attorney Cindy Ayres stated she would get with Carie Gwinn, at the Abstract office and find out what paperwork was needed. Motion passed unanimously.
11.) Adjournment made by MPT Billy Henricks, second by Council member Jon Hrncirik, to adjourn meeting at 9:20 p.m. Motion passed unanimously.
