CITY OF SEYMOUR CITY COUNCIL
MEETING MINUTES
SEPTEMBER 15, 2022
A Regular City Council Meeting was held on Thursday, September 15, 2022, at 7:00 p.m., at the Portwood Art & Civic Center, 800 E. Morris Street, Seymour, Texas 76380.
The following agenda was considered:
1. Call to Order, Roll Call and Pledge of Allegiance by Mayor Jon Hrncirik
Meeting was called to order at 7:00 p.m.
Council present:
Mayor Jon Hrncirik, MPT Les Hons, Council Members Mark McCord, Lan Winn, Sabrina Rivers, and Billy Henricks.
City Staff present:
Dr. Jeffrey Brasher, Conchita Torrez, Lauren Bush, John Davis, Chase Hoyt, John Smajstrla, and Part-time helper, Robert Torrez and Police Sergeant Bryce Sawyer.
Counsel:
City Attorney was not present at this meeting.
Guest:
Gayle King, Kimberly Stevenson, Harry Knowles, Patricia Knowles, Deborah Milbern, Krystal Butler, Stacy Holub, Vickie Oldham, Dennis Bott, Mary K. Fair, Carma Thompson, Deann Brady, Paula Vaden, Taylor Chandler, and Cole Chandler.
2. Prayer
Prayer led by City Administrator, Dr. Jeffrey Brasher
3. City Administrator Dr. Jeffrey Brasher will recognize the City of Seymour Department, and Employee of the Month.
Employee of the month was John Smajstrla, who works in the water department, under the supervision of Chase Hoyt. Dr. Brasher stated that John is a very dependable team player and does an excellent job. He is highly respected by his co-workers and is pleasant to work with and be around. A group picture was taken following his presentation.

Consent agenda was presented by City Administrator, no action was taken.
7. Public Hearings
a.) City of Seymour to conduct a Public Hearing establishing an ad valorem levy tax rate for the City of Seymour Texas, 2022. The Proposed Tax Rate for the City of Seymour is 0.43625 per $100 value, which is lower than the Voter-approval tax rate of 0.45803.
No one spoke for or against this public hearing, therefore, Mayor Hrncirik moved on to agenda item 7 b.
b.) City of Seymour conducting a Public Hearing regarding Fiscal Year, 2022-2023, Proposed Budget for the City of Seymour.
Council Member Mark McCord expressed his concerns regarding the delay of our Audit Reports. Dr. Jeffrey Brasher stated that city staff was working very hard to get caught up, but, assured him that the city was working toward a balanced budget.
8. Consent Agenda
a.) Approve the July 25, 2022 & August 25, 2022, meeting minutes.
b.) Approve the City of Seymour AP bills for the month of August, 2022.
c.) Approve Resolution No. 1531, adopting the Procurement of Administrative Services for the 2023-2024, CDBG Application.
d.) Approve Resolution No. 1532, designating the Baylor Co. Banner as the official newspaper for legal notices and announcements for the City of Seymour, Texas, as required by Texas Local Gov. Code, 52.004.
e. ) Approve Resolution No. 1533, the Atmos Rate Review Mechanism for 2022.Financial Reports
f. ) Approve “Junk Only” for Clean-Up Week, for the week of October 15th -October 23rd, 2022.
g.) Approve Resolution No. 1534, adopting the Engineering Services for the 2023-2024, CDBG Application.
Motion made by MPT Les Hons, to remove Consent Agenda Item B from the consent agenda to be voted on separately. After reviewing consent agenda as presented, a motion was made by Council Member Billy Henricks, seconded by Council Member Sabrina Rivers to approve the consent agenda. Motion carried 5/0
Account Payable Bills (Consent Agenda item B) Motion made by MPT Les Hons, seconded by Council Member Lan Winn, to approve AP Bills as presented. Motion passed with 4 Yeas and CM Rivers, abstaining from vote.
9. Action Items
a.) Discuss, consider, and take action to adopt Ordinance No. 2022-12, establishing the ad valorem tax rate for the City of Seymour, Fiscal Year 2022, at 0.43625 per $100 valuation, which is lower than the Voter-approval tax rate of 0.45803. The rate represents the Operation and Maintenance by conducting a formal vote of the city council for said ordinance.
Motion made by Council Member Mark McCord, seconded by MPT Les Hons, to approve Ordinance No. 2022-12, Ad Valorem Tax Rate of 0.43625. A formal voice vote of the city council was made by the following Council Members : MPT Hons- Yes, Mark McCord -No , Lan Winn- Yes, Billy Henricks -Yes and Sabrina Rivers -Nay. Ordinance passed with 4 Yeas 1 Nay
b.) Discuss, consider, and take action to approve Resolution No. 1530, adopting the Fiscal Year 2022-2023, City of Seymour Budget and conduct a Formal Vote of the City Council for said resolution.
Motion made by MPT Les Hons, seconded by Council Member Billy Henricks, to approve Resolution No. 1530, City of Seymour Budget, for 2022-2023. A formal voice vote of the city council was made by the following Council Members : MPT Hons- Yes, Mark McCord -No, Lan Winn- Yes, Billy Henricks – Yes, and Sabrina Rivers -Yes. Resolution passed with 4 Yeas 1 No
c.) Discuss, consider, and take action regarding VFW Hall/Bar Area bids located at 910 E. Nevada Street, Seymour, Texas.
The City of Seymour received the two following bids:
Seymour Helping Hands for $ 500.00
Rodney & Beth Hrncirik $10,100.00
After discussing this agenda item, a motion was made by Council Member Lan Winn, seconded by Council Member Sabrina Rivers to accept bid of $10,100.00 from Rodney and Beth Hrncirik. Motion passed with 3 yeas from Winn, Rivers, and Hrncirik. 2 Nays -Hons and McCord. Yeas passed with majority
d.) Discuss, consider, and take action regarding reimbursement of $15, 500.00K to the SVFD for the down payment to purchase a SVFD Pumper Truck. After discussing this agenda item, that was presented by MPT Les Hons, a motion was made. Motion made by Council Member Billy Henricks, seconded by Council Member Sabrina Rivers to allow City of Seymour to reimburse SVFD $15,500 for Pumper Truck.
Motion passed with 4 Yeas and 1 Nay by CM McCord. Mary K. Fair and Vickie Oldham made comments during this agenda item.
e.) Discuss, consider, and take action regarding bid notice for a TORO 4500 D lawn mower for the City of Seymour departments. One (1) sealed bid was received for this bid: D & D Equipment in the amount of $17,000, their bid was previously $16,500.00, but raised it up $500 dollars.
CM Mark McCord asked if this mower could not be put off until next spring, due to cold weather was coming up. He also asked if the lawn mower was not already at the SFRC? Dr. Brasher replied “Yes.”
Motion made by Council Member Sabrina Rivers, seconded by Council Member Lan Winn, to approve bid received for $17,000.00. Motion passed with 4 Yeas and 1 Nay by CM McCord.
f.) Discuss, consider, and take action regarding live-streaming City of Seymour Council meetings.
After discussing this agenda item, and hearing comments from Paula Vaden, Lauren Bush and Harry Knowles, a motion was made. Motion made by Council Member Mark McCord, seconded by Council Member Billy Henricks, to approve live-streaming for the City of Seymour meetings. 2 yeas by Henricks and McCord and 3 Nays by Hons, Winn and Rivers. Motion failed for having 3 Nays.
Regular meeting adjourned at 8:45 p.m. to go into Executive Sessions.
10. Executive Session
a.) An Executive Session, closed to the public and pursuant to Chapter 551 of the Texas Local Government Code, under §551.071, Consultation with City Attorney; Special Utility District-Baylor Water.
b.) An Executive Session, closed to the public and pursuant to Chapter 551 of the Texas Local Government Code, under §551.072, Lowe Stout Building.
Executive Sessions closed at 9:40 p.m.
11. Action regarding Executive Session
a.) Discuss, consider, and take action regarding Executive Session with City Attorney Motion made by Council Member Lan Winn, seconded by Council Member Sabrina Rivers, to allow City Attorney to pursue with mediation . Motion passed 5/0.
b.) Discuss, consider, and take action regarding Executive Session on Lowe Stout Building. Motion made by Council Member Mark McCord, seconded by Council Member Billy Henricks, to allow City Administrator to negotiate with SISD, regarding Low Stout Building. Motion passes 5/0.
12. Adjournment of meeting
Motion made by MPT Les Hons, seconded by Council Member Billy Henricks, to adjourn the meeting at 9:43 p.m.
