February 17, 2022

A Regular City Council Meeting was held on Thursday, February 17, 2022 at 7:00 P.M. at the Portwood Art & Civic Center, 800 E. Morris Street, Seymour, TX  76380.

1. Call to Order, Roll Cal & Pledge of Allegiance by Mayor Jon Hrncirik

Mayor Jon Hrncirik called the meeting to order at 7:00 p.m.

Council Present: Mayor Jon Hrncirik, MPT Monty Glass, Council Member Lan Winn, and Council Member Les Hons

City Staff Present: City Administrator Dr. Jeffrey Brasher, E.d. D., City Secretary Conchita Torrez, SFRC Supervisor Todd Hrncirik, Water/Sewer/RO Plant Supervisor Robert Torrez, Electric Supervisor Anthony Arjes, Street Supervisor Shawn Sanchez, and ED Director Lauren Bush.

Guest Present: Dale Garner with AEL, James Johnson, Kim Johnson, Cory Glassburn, Merle Rodgers, John Zielasko, Sharon Zielasko, Roxanna Rogers, Mark McCord, Leslie Stacy, Josh Stacy, Macey Hardin, Mary K. Fair.

2.   Council member to lead Prayer

     City Administrator Dr. Jeffrey L. Brasher Ed.D., led prayer

3.   Mayor or MPT Announcements

      Mayor Jon Hrncirik stated Baylor County had under 5 Covid Cases,

      and Mayor Hrncirik also congratulated the Seymour girls and boys

      basketball teams for their successful season.

4.   City Administrator Reports

              (a) Employee list & SFRC Golf total (106)

              (b) Supervisor Written Reports

              (c) Employee Appreciation Luncheon

City Administrator Dr. Jeffrey Brasher stated the SFRC Golf totals, Supervisor Written Reports were included and the council packets, and the Employee Appreciation Luncheon was scheduled for March 4, 2022, at the Portwood Pavilion from 11:30 A.M. to 1:30 P.M.   Dr. Brasher reminded the Mayor and City Council they were invited as well.

5.    Citizen Comments

Mr. McCord spoke during this time in regard to a paving job that had been discussed last year regarding the Plainview Addition.  Mr. McCord stated it was in bad shape.

6.    City Administrator Dr. Jeffrey Brasher to recognize Employee(s) of the Month

Dr. Brasher stated the city departments all worked together during the snow/ice storm and he was very proud of them for working together as a team.  He recognized each supervisor for their hard work and presented a certificate to Supervisors Todd Hrncirik, Robert Torrez, Anthony Arjes and Shawn Sanchez.

7.    Public Hearings

        (a) Second and Final Public Hearing regarding the request of a

                 Specific Use Permit for Tiny Houses located at 511 N.

                 Stratton Street and 302 N. Tackitt Street, from James and

                 Kim Johnson.            

Economic Development Director Lauren Bush stated that this was the second and final public hearing for Mr. and Mrs. Johnson.  All requirements had been met with the exception of the square footage for minimal use. 

There were no questions from citizens, therefore, this public hearing closed.

        (b)  Public Hearing regarding the request of an Easement

                   Agreement for 200 S. Foley, from Brenda Hardin.  

Economic Development Director Lauren Bush stated that Ms. Brenda Hardin was requesting an easement due to the carport encroached on city property.  It was stated that city staff could still go through the alley without any problems and there were no city lines around that area to be concerned about. 

There were no questions from citizens, therefore, this public hearing was closed.

                (c)   Public Hearing regarding the request of an Easement

                  Agreement for 611 N. Arkansas Street, from John

                  & Sharon Zielasko.

Economic Development Director Lauren Bush stated that Mr. & Ms. Zielasko were requesting an easement on their property, due to an encroachment on city property.  City staff still could drive through the alley if needed without any problems and there were no city lines around that area to be concerned about.

There were no questions from citizens, therefore, this public hearing was closed.

          (d)  First Public Hearing regarding Zoning Ordinance, adding (F)

                   to Section 5: Miscellaneous Service Charge; After hours

                   water turn on/off fee for repairs.

After reviewing the ordinance regarding water turn on/off fee for repairs after hours, City Staff would like to raise the water fees from $15.00 to $35.00. This is the first of two public hearings.  

Mary K. Fair suggested that the price should not be raised more than $35.00.  Robert Torrez suggested that each resident put a water cut-off on their property.

 No action was or will be taken until next month at the Regular City Council meeting.

          (e)  First Public Hearing regarding Zoning Ordinance, for a

Specific Use Permit Application Fee, Section 17: Adding Specific Use Permit under B. Conditions and Guarantees and Appendix A, Fee Schedule.  

Economic Development Director stated that each time a Specific Use Permit Application is requested, it cost the City of Seymour around $200.00 to have all the necessary paperwork completed.   No action was or will be taken until next month at the Regular City Council meeting.                         

     8.  Consent Agenda

                (a) Approve January 20, 2022, Regular City Council Meeting

                Minutes.     

                     (b) Financial Report

                     (c) Discuss, and take action regarding City of Seymour A/P                

                  bills paid the month of January, 2022.                    

                     (d) Authorize City Staff to advertise for Junk Only- No brush,

                   Clean up Week to be held Saturday, April 9th through

                   Sunday, April 17th, 2022.

    After reviewing the Consent Agenda, Mayor Hrncirik asked that agenda item (d) be removed for separate discussion.  

      Motion made by MPT Monty Glass, a second by Council Member Lan

      Winn to approve the consent agenda with the exception of item (d). Motion carried 3/0.

      Following was the discussion of Spring Clean Up in which the Mayor

     suggested that both Junk and Brush be picked up.  After a discussion

     was had, decision was made to leave as is with only Junk being picked

     up. Motion carried 3/0.  

            9.    Action Items   

             (a) Discuss, and take action approving Election Resolution No.  

                 1521, appointing Election Judges and Clerks for the May 7,

                 2022, General and Special Election.                                   

Motion made by Council Member Les Hons, and a second by Council Member Lan Winn, approving Election Resolution #1521.  Motion carried 3/0

             (b) Discuss, and take action approving the Order of Election

                   for the May 7, 2022, General and Special Election.      

Motion made by Mayor Pro-Tem Monty Glass, with a second by Council Member Lan Winn, to Res. #1521. Motion carried 3/0              

               (c)  Discuss, consider, and take action to approve the Annual

                       Racial Profiling Report as presented by Seymour PD

                    Sergeant Bryce Sawyer.  

Motion made by Council Member Les, with a second by MPT Monty Glass, to approve the Racial Profiling Report.   Motion carried 3/0

                (d)  Hear presentation and take action regarding request from

                          Leslie Stacey on Grand Opening Events scheduled for

                      April 23rd, 2022.

Leslie Stacy handed out an outline of her discussion to Mayor Hrncirik and City Council regarding her Grand Opening scheduled for April 23, 2022. She had a few things she asked to be approved by the City Council. Things that were discussed at this meeting were the following:

following :

1.  Blocking off some streets            

2.  having a goat roping

3.  would like for the City to provide trash bins and pick up                                

after event

4.   Open Container allowing citizen’s to have beer and wine

5.   inquired about the Noise Ordinance as this event will go

into the midnight hours.

6. Trade Shows, Food Trucks will also be available as well as

booths.

7.  Jay Hooker Band would also be there for entertainment

Several other things were discussed regarding this event.

Motion made by MPT Monty Glass, a second by Council Member Les Hons, to allow Leslie Stacy to go ahead with her plans.  Motion carried 3/0

      (e.) Discuss, consider, and take action regarding the relinquishing of personally owned lift stations that are maintained by the City of Seymour.

Mary K. Fair commented that customers should maintain their lift stations and not be the City’s responsibility.  

Robert Torrez commented that when a lift station goes down, it takes 4 employees to be available every time it goes down.  It cost the City anywhere between 1,300 -1,400 to repair each time they break down.

Motion made by MPT Monty Glass, second by Council Member Lan Winn, to allow the City to relinquish the lift stations back to the customer it serves.    Motion carried 3/0.   

Dr. Jeff Brasher is to write a letter to the customers it will affect. 

       (f) Discuss, consider, and take action to approve the City of

            Seymour Audit for Fiscal Year 2019-2020.

Motion made by MPT Monty Glass, second by Council Member Lan Winn, to approve the City of Seymour Audit for Fiscal Year 2019-2020.   Motion carried 3/0

        (g)  Discuss, and approve the City of Seymour City Pool Fees

                 and Operation hours for 2022.

Motion made by Council Member Lan Winn, second was made by Council Member Les Hons, to approve the City of Seymour Pool Schedule for 2022.   Motion carried 3/0

Citizens will be allowed to reserve the City Pool for parties on April 11, 2022.  For a copy of pool prices and information contact City of Seymour website or come by City Hall to obtain a copy. 

        (h)     Discuss, consider, and take action to approve Manufactured

                  Housing without a permit.

ED Director explained to City Council that that this was only for new manufactured homes, and it would be for the east side of town. A lot more information was provided by ED Director Lauren Bush. To obtain this information, please contact Lauren at City Hall.

This will be discussed again as an action item at the March, 2022 meeting.

         (i)       Discuss, consider, and take action regarding trash services

                   for the City of Seymour.

City Council discussed the trash rates and services that Waste

Connections will provide.  Figures will be provided at the next council meeting along with a public hearing and allow citizens to ask questions and voice their concerns.  

Motion made by MPT Monty Glass, second by Council Member Lan Winn, to proceed with information at the next council meeting. Motion

carried with 2 yeas  and 1 nay by Council Member Les Hons.               

         (j)       Discuss, consider, and take action to approve Easement

                    Agreement for Brenda Hardin, 200 S. Foley.

Motion made by MPT Monty Glass, a second by Council Member Lan Winn, to approve an Easement Agreement for Brenda Hardin, regarding 200 S. Foley Street.  Motion carried 3/0      

         (k)       Discuss, consider, and take action to approve Easement

                    Agreement for John & Sharon Zielasko.

Motion made by Council Member Les Hons, second by MPT Monty Glass, to approve an Easement Agreement for John & Sharon Zielasko, regarding 611 N. Arkansas Street.  Motion carried 3/0 

         (l.)      Discuss, consider, and take action approving the “In User

                    Jet fuel” Agreement.

Motion made by MPT Monty Glass, a second by MPT Monty Glass, to approve and add the “In User Jet Fuel” to the current Airport Lease Agreement.  Motion carried 3/0

       10.   Adjournment

 Meeting closed at 8:48 p.m.  with a motion by MPT Glass, second by  Council Member Lan Winn.  Motion carried 3/0
