COUNCIL MEETING MINUTES

A Regular City Council Meeting was held Thursday, March 16, 2023, at 7:00 p.m., at the Portwood Art & Civic Center, 800 E. Morris Street, Seymour, Texas 76380.  Notices have been duly posted in accordance and conformance with the Government Code of the State of Texas, Section 551.002(c). The City of Seymour attempts to make its meetings accessible to all citizens. If you have need of auxiliary aids, please notify the ADA Coordinator at 940-889-3148, at least 48 hours in advance.  The following agenda will be considered:

1.  Call to Order, Roll Call and Pledge of Allegiance by Mayor Jon Hrncirik

Called to Order at 7:00pm

Present:  Mayor Jon Hrncirik, Lan Winn, Mark McCord, Debbie Gillispie, and Billy Henricks.  Also Dr. Jeff Brasher, Lauren Bush, John Davis, and Sergeant Bryce Sawyer.

Absent:  MPT Les Hons

Mayor addresses the public and council that comments may be made at Citizens Comments, Public Hearings, and one agenda item.

3.  Citizen Comments

Kaitlyn Stevenson – A request by Seymour Helping Hands to have a proposed project placed on the agenda for April.  Project is a leashed dog park and Welcome to Seymour area located off of FM422 and N. Tackitt on City owned property in honor of Mark Alabuagh.  Seymour Helping Hands would maintain the area.

4.  Public Hearing(s)  

(a.) One of Two Public Hearings regarding the Water Conservation Plan and Drought Contingency Plan for the City of Seymour, Texas as recommended by Jacob & Martin, Inc., Representative Tristan King.  

Tristan King addressed the council explaining the need and positive impact the updating of the Contingency Plan is for the City of Seymour.  Should be updated every 5 years.  Our population is below the state requirement to update, we do not do surface water, and there is not a Texas Water Development Board financial assistance program at this time so we are not inherently required to update the plan however, it is good practice and a tool we can use in planning.

McCord:  Request to have clarification why there is a 30% water loss shown in the documents and is that a typical amount?

King:  Water loss comes from flushing lines, leaks, fires, flushing hydrants and dead-end lines and other typical maintenance.  The amount of loss is typical.

(b.)  First and Only Public Hearing regarding the modification of Transfer Hours of Operation as read in Ordinance No. 2022-07.  Modification change would be Tuesday – Saturday, from 10:00 a.m. – 5:00 p.m.

Brasher:  At Mr. Byrket’s request he is asking that the hours be changed because there was little to no activity from 5pm to 6pm.

(c.) Public Hearing on Substandard structure and public nuisance at 1007 N. Main Street, owned by Ette Properties (Jake Willden).

VIOLATION: Unsafe, Dangerous, or Hazardous Buildings and Structures # 2019-02. Any building that is dilapidated, substandard, or unfit for human habitation and a hazard to the public health, safety & welfare.

DESCRIPTION: White severely dilapidated structure that is collapsing in on its self and has and Gambrel like style roof with wooden shingles around the upper portion of the exterior walls.

(d.) Public Hearing on Substandard structure and public nuisance at 110 W. Ingram Street, owned by John and Olga Lopez.

VIOLATION: Unsafe, Dangerous, or Hazardous Buildings and Structures # 2019-02. Any building that is dilapidated, substandard, or unfit for human habitation and a hazard to the public health, safety & welfare.

DESCRIPTION: Severely burned single-wide blue mobile home with brown underpinning, white window trim, and an unattached metal car port.

(e.)  Public Hearing on Substandard structure and public nuisance at 503 S. Main, owned by Adis Latham and Laurie McKerlie.  

VIOLATION: Unsafe, Dangerous, or Hazardous Buildings and Structures # 2019-02. Any building that is dilapidated, substandard, or unfit for human habitation and a hazard to the public health, safety & welfare.

DESCRIPTION: Formerly white single-family home with multiple sheds that all have severe damage from fire.

5.  Report(s)

(a.)  Discuss, and hear update regarding the City of Seymour 2021-2022 Financial Audit Process and Finance Report by Mary Griffin, Finance Director.

Discussion, No Action

(b.)  Discuss, and hear update from Kim Stevenson, representing the Seymour Helping Hands Car Show, as requested by City Council.

Time line 9am to 4pm, staff present at 7am til clean, 40 cars RSVP’d hoping for 75, 57 venders RSVP’d 10 food trucks, People coming from San Antonio from Oklahoma, Magazines are doing articles.  Requesting to close road at the Portwood Pavilion and around to the park sheds for safety purpose.  Would like cones as well.  No alcohol allowed.  Hotels offering discounts for attendees.  Live feed from 104.7 Bear.

6. Storage Tank Bid(s)

(a.)  Discuss and take action regarding bids on Storage Tanks at the Reverse Osmosis Plant. Presented by Tristan King, Representative of Jacob & Martin, Inc.

Tristan King:  March 2nd we opened bids, there were 3 tanks that we are looking to rehab.  Project being funded with American Rescue Plan Funds.  Base Bid:  Sandblasting the interior of half million gallon tank, the largest tank, that serves as finished water holding tank. 2nd Bid:  To rehab the interior of the 220,000-gallon finished water tank.  3rd Bid:  To rehabilitate the interior of the 150,000-gallon holding tank that we call the “Head Tank” located up on the hill. We received 6 bids on this project.

Our recommendation is to award the base bid and added alternate A1, which are the 2 finished water tanks, at the cost of $168,000.00.

Motion By CM Billy Henricks to accept the bid from Champion Tank Services in the amount of $168,000.00

7.  Action Items

(a.) Consider and take action on an order regarding Substandard structure and public nuisance at 1007 N. Main Street, Seymour, Texas 76380, that is owned by Ette Properties (Jake Willden). (R 8965)

Motion by CM Lan Winn to give Jake Willden 180 days for abatement with no fine as of now.

(b.)  Consider and take action on an order regarding Substandard structure and public nuisance at 110 W. Ingram Street, Seymour, Texas 76380, that is owned by John & Olga Lopez.  (R8597)

Motion by CM Mark McCord to table item and place on next month’s agenda and have Lauren Bush speak with owner to explain actions that will take place in the next 30 days.

(d.) Discuss, consider, and take action regarding the opening of the shooting range at Salt Fork Recreational Complex.

Dr. Brasher:  Baffle complete and donations received by John Horn of $1,500.00.  Insurance wants us to have a Range Manager.  A consultant was spoken with and their recommendation was to have multiple people trained and they were able to provide this NRA training as well.  

Against:  John Hostas, 1125 CR 400 – Has experienced at 2 different instances where bullets shot from the gun range struck his back yard tree and the tree in his front yard, as well as trees in the neighbors yard to the South.  Request that the gun range be permanently closed and only opened for special events like the rail gun competition and police qualifications. Haylee Hollar – Concerned about fencing, safety, and staffing.  Robert Golden – Moved here and was looking to sight in my weapons.  Is there a chance we could have a day fee instead of a monthly rate.

Pro: Oscar Valdez – Believes the facility is one of the best and would be willing to volunteer at the range if need be.  John Zilasko – Would like to use the facility for certifications and would like the police to be able to use it as well.  Shawn Stevens – I am for opening it. 

Flora Dosey – would like 24 hour surveillance and safety measures well discussed.  What is the cost and is it worth it?

Kim Stevenson – Concerned about the minimum acreage requirements and the fact that the Fishing is poorly regulated could reflect that the gun range will also be poorly regulated.

CM Mark McCord does not feel like the City should open the range.

CM Lan Winn gives direction to Dr. Brasher to price cameras for the location.

(f.) Discuss, consider, and take action to approve Resolution No. 1545, regarding a Budget Adjustment, for Fiscal Year 2022-2023, for Salt Fork Recreational Complex, in the amount of $4,985.00, regarding a main pump station.  These changes will not increase the overall budget.

Motion made by CM Billy Henricks to open the pool for Senior Swim 12pm – 1pm, Public Swim from 1pm – 6:30pm, Tuesday through Friday, Saturday 12pm – 6:30pm,  & Sunday 2pm – 6:30pm. Parties Tuesday through Sunday from 7pm – 9pm.  Party prices – $100 Pool & $75 Splash Pad Party with 25 swimmers, $125 for Pool & Splash Pad Party for 25 swimmers, Additional charge remains for extra swimmers.  And if there is a lack of lifeguards, Dr. Brasher is allowed discretion
